Please read these terms an conditions carfully befor applying for an ANN Finance Loan:

Consequenses of missing a payment

If you fail to make the repayments under the loan agreement, we may charge you our reasonable costs incurred, for example if we have to instruct parties to trace you, return any payments, carryout debt collection activities or take legal action against you. Missing a payment under the loan agreement may affect your credit rating, which may make it more difficult and/or more expensive to obtain credit in the future.

Your Right to Withdraw
You can withdraw from a loan agreement, without giving a reason, within 14 days beginning with the day after the later of:

  • The day the agreement is signed by us
  • The date on which we tell you we have signed the agreement in identical form to the cop provided to you; or the date on which you receive a copy of the agreement which has been signed by is and you.
  • If you would like to withdraw from the agreement you must tell us in writing, or by telephone, using the details on our contact us page of this website, or by speaking to your agent. If you choose to withdraw from the agreement you must repay the amount of credit we have paid to you in full within 30 days of you informing us of your intention to withdraw.
Credit Reference Agencies
If we decide not to proceed with your application on the basis of information received from a credit reference agency, we must inform you that we have decided not to proceed with your application on the basis of the information from the credit reference agency and provide details of that agency.

Refinancing
Refinancing or otherwise extending the term of your loan agreement will extend the period of indebtedness and may cost more.


Continuous Payment Authority
If you do not wish for us to collect repayments at your home, we will, either collect your repayments by direct debit or by debit card using continuous payment authority (CPA). the method of repayment will be agreed with you when during your loan application.

If you consent to us collecting payments from your nominated bank account using CPA, we may use this authority to take your payments on a regular basis, as set out below and in your agreement. If we are unable to collect a payment, we shall make 1 further attempt to request payment on the next working day, unless we have already agreed with you to make the request for payment on an alternative date.

If we have tried to use the CPA twice without managing to obtain payment , we will stop using the CPA to request payments and will attempt to make contact with you by phone, email, and or text message. you can cancel your direct debit or CPA at any time by contacting us, using one of the methods detailed on the contact us page of this website.
Alternatively, you can tell your bank that you wish to stop making payments to us by direct debit or CPA.


Before you make your application for an ANN Finance Short Term Loan:

You will be required to provide the following information:

  • Your current and previous address if you have been at your current address less than 2 years

  • Proof of ID and occupancy

  • Details of regular income and outgoing payments.

  • Employment status.

  • A valid Email address

You will need to confirm the following:

  • You are over 18

  • You have read and understood our privacy notice

  • You agree to our terms and conditions

  • You agree for us to carry out the necessary credit checks

  • You are not bankrupt

  • You have no County Court Judgments (CCJ's)

  • You have no Debt Relief Orders (DROs) or Individual Voluntary Arrangement (IVAs)

  • You are a Uk Resident

Before entering an agreement of and ANN Finance Ltd loan means that:

You Must

  • If you change your personal details such as Name, Address, Telephone number or Email address, tell us within 14 days.

As a Result
All notices and statements given to you  in person or left at or sent to your address shall be considered validly given within 2 working days after informing us.
If two or more people are named as the customer, the liability of each shall be joint and several. This means that each person can be fully responsible for all responsibilities set out in our agreement. Signature of this agreement acknowledges:

  1. That you received prior to signing this agreement the pre contract information.

  2. Receipt of a true copy of the agreement

  3. That the money received is for the personal use of the customer.

You May

  • Be entitled to a rebate in accordance with the Regulation 95 of the Act if you repay early in part or in full

  • If you wish , tell us that any or all of your payments under this agreement are to be collected by us or someone acting on our behalf from your home or home of a person making payment on your behalf.

You Have a Right

  • To a statement of account showing details of each instalment owing under the agreement, the date on which instalment is due, the amount and any conditions relating to the repayment of the instalment and a breakdown of each instalment showing how much comprises

    1. Capital repayment

    2. Interest repayment

    3. And if applicable any other charges

You Agree

  • To pay the lender the instalments set out in your loan agreement.

  • If your 'Type of Credit' is described as 'home collected' to a representative calling on you in your home to collect repayments.

  • That the lender making a Credit Reference and Fraud Prevention Agency search may be recorded by the agency concerned and shared with other lenders

  • If you default or are suspected of fraud, that other lenders may use this information about you and others with whom you are financially linked for credit assessment, debt tracing, fraud and money laundering prevention.

Your Data may be used

  • In accordance with the Privacy Notice that you will have signed your agreement to, when required by law or where permitted under the UK Data Protection Act 2018, also known as the General Data Protection Regulation (GDPR)

  • To manage your account and make collections/trace you

  • To search your record at Credit Reference Agencies and Fraud Prevention Agencies and make reports to such agencies of your loan account including positive, delinquent and default data.

  • To enable us to contact you using any of the contact information (email, telephone, SMS) you have provided for this purpose.

  • If we transfer, charge or assign this agreement or if we use a third party to manage any aspect of this agreement we may pass your information to them.

  • You have the right to:

    1. Access the information we hold about you

    2. Ask us to make changes to your information to make sure it is accurate/up to date

    3. As us to stop or limit processing or delete your information

    4. Receive your information in a format that suits you

    5. Transfer your information to a third party.

We May

  • If we temporarily relax the terms of the agreement at any time, decide to enforce the terms strictly again.

  • Add additional charges to your account if we carryout trace searches to identify your place of residence.

  • Allow another person to take over our part of the agreement. That person will then take over all rights and responsibilities under this agreement. 

A. Add additional administration charges to your account.
B. Add additional trace search costs to your account.
C. Add court costs to your account.

  • Acting resonably end the agreement, after giving any written notice required by law if:

    1. You fail to keep any part of the agreement.

    2. You commit and act of bankruptcy (such as failing to pay a debt as ordered by a court)

    3. You have given false information in connection with this agreement.

English / Scottish Law
In the event that the address you have specified is within Scotland, the Credit Agreement shall be subject to Scottish law and the courts of Scotland shall have jurisdiction to deal with any proceedings relating to the credit agreement. Otherwise the credit agreement shall be deemed to be made in England and shall be subject to English law and the parties agree to submit to non-exclusive jurisdiction of the English courts.
